The claim of incompetence is a far better one in my opinion.
Its easy to prove.
Also Marcs call for an analysis of bang for the buck
...how many conversions for each dollar spent [ or thousand dollars spent] is a good way to illuminate the ground here.

Why is it, that I have had to request the IRS 990 Annual reports from MAC three times now. Twice by e-mail, and once by fax. They are obligated, by law, to supply these within 30 days to any written request...which includes e-mail & fax. My first request was almost 30 days ago, and the most recent by fax was a week ago.

Then when you look at their goals, at least the old ones that are available, they are all very vague with a lot of slip room. For example, what does "To raise awareness through public aquariums of conservation and the marine aquarium trade" mean, and how is it measured for success?. That's what they were doing with the MacArthur Foundation money. Or how about "to develop and undertake international multi-stakeholder process to create standards of best practice for the Live Reef Food Fish Trade", and how is it measured for success? Thank you the Packard Foundation (cha-ching).

Goals have to be measurable and realistic, or they are just words.

HOW ABOUT ACTUAL DELIVERABLES! NOT SOFT, VAGUE GOALS!

I am going to try and do a follow-the-leader on the money trail, and then create a return on investment analysis of MAC's performance over the last three years. All,



Since my previous posting it has now been regretfully confirmed that Criminal proceedings (Ref IS 06D5239) have been made against the MAC/MAMTI Staff of Paul Holthus, Arun Abraham, Carmen Mercader, Michael Ocana, Michael Ramos and Stuart Green for violating the Philippines Republic Act 8792 (Philippine E-Commerce Act).

Well he did re-post as invited to...and it turns out that it was not slander at all...but an upcoming case.
Its a case number in a Philippine court.

I just happen to have saved a copy of the original post. It is obviously more of a "leak" than a question. Regardless, it begs the question as to just what is in that USAID report. Does anyone have a link to that report?

While vitz may have been "Shallow Navel". :P, when he leaked the USCRTF Draft Legislation way back when, we appear to have our very own bonafide "Deep Throat" now. RDO is the Washington Post of the bulletin boards. :wink:

I must admit, that the real one was the one we were kinda stuck on all this time.
I didn't relize that the world's new environmentalism valued paper planning over real life achievement. They have certainly funded their own failures far more then they have supported real life work.

It has been over 30 days since I made my first two requests via e-mail to MAC for copies of their IRS form 990. Under US Federal Tax Law, as a NPO they are required to provide this information to anyone that requests it in writing. They are to supply the report within 30 days of receiving it, and the requestor can request up to the most recent three filing years.

I sent my third request via fax on March 24, so right now we are at 20 days and still no reports. I informed MAC in my fax that my fourth request would be via certified mail, with copies to the IRS and Dept. of Justice. I am hoping that they respond with the requested material.

If MAC does not respond and I am forced to the certified mail request, I will also file a formal complaint with the appropriate authorities. I have also looked into filing a civil complaint in Federal Court if it should come to that.

Luckily the law is very clear, and I expect them to comply.

I think your biggest problem is that you made responses via email instead of a physical letter return receipt. They can simply say "we never got the email". I also dont know if that is considered "in writing" or not.

The IRS page states that "If the request is made in person, nonprofits must provide copies of the forms immediately. If the request is made in writing, by fax, or e-mail, not-for-profits have thirty days to mail out copies."

Also "Nonprofit employees are subject to fines of twenty dollars for every day they fall behind in providing the form(s), up to a maximum of $10,000 per return. In addition, a $5,000 penalty for "willful failure" can also be applied."

The nice thing about e-mail, is that in a legal fight you can subpoena things like server logs that will show the e-mail reached their account. Depending on how it is setup, it may also tell whether or not it was read. I have a successful fax report that the fax went through on the 24th. On April 25th I will send a certified letter requesting the information, and will also file a complaint with the IRS.
