Abolutely right. Plus, if you have hard facts that can back up your statements, then why would they possibly sue? They'd just lose.

You never followed up with either Len or I, both of us offering to help you change your screen name.
I also remember a pm or post where I asked you if you still wanted it changed to which you replied that you 'decided to just keep it...'

Again, if you want it changed send me a pm, but please stop blaming admins for your lack of follow up.

Yeah but it can cost you a couple hundred thousand to defend yourself against a monster lawsuit. Even if it has no basis.

i wonder what the ratio of threating to sue vs actually suing is?

10 to 1 or 1000 to 1. we will never know but i bet it is astronomically high!

Its what tort reform is all about.
The abuse of the legal system by weenies, whiners, windbags, and insecure wannabies is ruining it.
The cavalier threat to sue should be seen by the culture as an admission of insecurity and inability to defend oneself with deeds, words and reasoned argument.
The % of threats to sue are inversely proportional to the fragility and hypersensitivity of the self imagined victim.
There are reasons to sue to be sure....the problem is the dilution of just cause by the shallow ones.

You bunch of babies. I didn't get sued and if someone was going to get sued.... You just have to tell the truth and be ready to defend yourself if need be. As long as your not attacking someone just to attack someone, you shouldn't have to be worried. I can see if your giving away trade secrets of a company that you use to work for, but for just stating a fact that someone is drop shipping for this company, well that is just part of the game. People can do what they want with the info, if a company is hiding the fact that they drop ship or use drop shippers, it sure makes you think they would be hiding other details as well. To me that is the most important detail, if a company is honest about its products or how they do business, then you can trust them on other issues, but if they are hiding things, using a lot of smoke and mirrors, then you have to wonder about anything they say.

Let's not forget as well that the box weight is counted in 45lb box or whatever (always has been for me anyway). So the net weight of actual rock is a little lower too. So the customer is not wasting any money on the box when picking up. At least I hope they aren't.

I had a customer tell me that they went to one store, and picked out a rock they wanted, and the employee grabed a whole sunday newspaper, and wetted it down just to cover the rock before puting it in the bag.

Then he weighed it.

The customer promptley exclaimed that he was not going to pay for the weight of the wet newspaper, but the employee said that was the way they did it. The customer walked out.

I know in my state (WA) you legally need to have scales calibrated and stamped in order to sell any item by the pound. It asks you on the MBL registration.

Nearly the same deal in CA. IF done by weight, you have to have the scale signed off by Weights and Measures, which is part of the county government, at least in my area :D

also as a thought,


A reason I know some e-tailers do some stuff "cheap" is to attract customers onto coming back to buy the other stuff they sell online. I know as a fact that sometimes there is no real proffit. They include shipping in the price and sometimes shipping is so mo much that they are only making 10 , 20 if that much $ on a 45 box. BUT almost always that same customer will buy other live goods. That is why I think sometimes it looks cheaper online.

Also a good point. Loss leaders are a key factor in good marketing and salesmanship. Why do you think the bread and milk are always at the furthest point from the door in a grocery store? Because the store doesn't make any or much money on them, so you have to walk past a pile of high-profit stuff to get to them, and odds are good that you'll grab something else on impulse as you schlep to get them. Ditto with point-of-purchase displays - the candy bars and magazines and other impulse stuff at the register are high profit, so even if the store loses money on the gallon of milk or loaf of bread, chances are they'll make it back and more with the other goodies you pick up along the way.

The same would likely apply in this comparison... I've heard tell of plenty of hobbyists who buy more because after a certain dollar point, shipping is cheaper or free. I saw one shopping cart on a pet supply site (years ago - could have even been the now-defunct pets.com) that would tell you as you checked out, "You can add X pounds more to your order for the same shipping cost." Of course that was a great incentive to add more stuff to the order to economize on shipping, even though the buyer may not need anything else.
